Dear Ed,

The attached piece of Unsolicited Commerical E-mail (UCE) was recently received from Heritage Rare Coin Galleries.  This e-mail violates Section 17511.1 and Section 17538.45 of the California Business and Professions Code as amended via AB 1629 and AB 1676, each new or modified section effective on January 1, 1999.  I have also attached copies of the complaints filed with the San Jose Police Department and the Santa Clara County District Attorney in this matter.

Please note that this is NOT Heritage's first offense in sending UCE, as I have requested at least twice in the past to be removed from their e-mail list and still continue to be subjected to their unwelcome intrusions.   The first two times were simply unethical, this latest one is patently criminal.

I wish to charge Heritage with violating the ANA Dealers Code of Ethics as published most recently in "The Numismatist", January 2000, page 119, specifically the principle requiring dealers "To abide by all local, state and federal laws in all numismatic matters and to assist in the prosecution of violators of the law in this respect".   I request that the sanction imposed be the sole remedy listed in this Code of Ethics, the expulsion of Heritage and/or its principals from the Association.
